INTRODUCTION

Thanks for viewing Home Properties, Inc.’s Privacy Policy on our website (“Site”). We value your trust, and this Policy explains how we and our affiliates, subsidiaries and related entities (“we,” “us,” etc.) use information which identifies you personally or is associated with information that identifies you (collectively, “Personal Information” or “PI”). Unless otherwise specifically stated, this Policy applies only to PI that we gather or collect, actively or passively, on the Site and any other Home Properties website that is linked to this Privacy Policy. It does not apply to any Personal Information collected offline or otherwise outside of the Site.

 

After you have reviewed this Policy, if you have not done so, please also review our (“Terms”), which also govern your use of the Site. If you use the Site, you will be deemed to have consented to be bound by the Terms and this Privacy Policy.

CHANGES; CONSENT


We reserve the right to amend, update, remove, or revise this Policy at any time, so please check this page periodically for changes. If we make any change which is unacceptable to you, you may stop using the Site. But if you continue to access or use the Site after we post any such change(s), you will be deemed to have accepted the changes. Information we gather now will be used in accordance with our Privacy Policy in effect at the time of use. We expressly reject any terms and conditions proposed by you which are in addition to or which conflict with this Policy or the Terms.

COLLECTION OF INFORMATION ABOUT YOU


Active Information Collection.

 

We may actively collect Personal Information from you at various places on the Site. For example, this could happen when: (a) you fill out and submit online forms (such as forms requesting information we might need to consider you as a renter of one of our apartments or as a potential employee), (b) you pay us through the Site, (c) you participate in a promotion, sweepstakes, or other contest on the Site, (d) when you post to any interactive forum we make available on the Site, or (e) you submit a survey response or request an e-mail communication(s) through the Site.

 

Passive Information Collection.


We automatically collect certain information about activities on the Site (“Site Use Information”). This is done through third party services and includes, for example: (a) when and how often you come to each Site page and how long you stay, (b) what type of browser and operating system you use to view the Site, (c) the domain name of your Internet service provider and your computer’s IP address, (d) the URL of the prior website that you came from, and (e) what you “clicked on.” An IP address is a number that is automatically assigned to your computer whenever you access the Internet, and our web servers use that IP address to send the information your computer requests.

 

To collect Site Use Information, we use cookies, web beacons, and similar technologies.

 

  • “Cookies” are small pieces of information that are stored as text files by your Internet browser on your computer’s hard drive. Most Internet browsers are initially set to accept cookies.   • “Web beacons” assist in delivering cookies and help us determine whether a web page on the Site or an email has been viewed and, if so, how many times. Web beacons allow us or the party that set the web beacon to monitor and collect certain limited information about the viewer of the web page or e-mail message similar to the information collected by cookies, e.g., the type of browser downloading the web beacon, the computer’s IP address, the time the web beacon was viewed, and the URL of the page the web beacon comes from. We use web beacons to count visitors, to see how they use the Site, and other purposes. We may also include web beacons in e-mails to count how many e-mails (or particular articles, links, etc.) were actually opened after we sent them.

“Off-Site” Information Collection.

This might be when you: send us an email, submit a paper application to rent an apartment, make a rent payment by check, or call or visit one of our property management offices. This Policy does not apply to PI you give us outside the Site. However, if we combine your “off-Site” and “on-Site” PI, we will apply this Privacy Policy to the combined PI unless we specifically tell you otherwise.


Information From Third Parties.

 

If you apply for an apartment or employment, either on- or off-Site, we may get information from third parties about you, e.g., your credit rating, etc., as part of that process. Please note that this Policy does not apply to PI obtained from third parties. However, if we combine that PI with PI we collect through the Site, this Privacy Policy will apply to the combined information (unless we specifically tell you otherwise).
 

HOW WE USE YOUR PERSONAL INFORMATION

We use your PI to: (a) contact you or fulfill your requests, e.g., for goods, services, or information; (b) process any application, payment, change to your account information, or other PI you have provided us; (c) tell you about information or offers we believe might interest you (e.g., apartment tours); (d) conduct surveys or tell you about a contest or promotion in which you have shown an interest; (e) conduct pre-screening of you as a possible tenant at one of our properties; or (f) complete any other purpose disclosed at the time you give us the applicable PI. We may also use your PI to improve the Site or other services we provide or for other reasonable business purposes.

SHARING YOUR PERSONAL INFORMATION WITH THIRD PARTIES

We do not share your Personal Information with third parties for their marketing purposes. We may share anonymous Site Use Information or other aggregated user statistics with third parties. In addition, we may share your Personal Information as follows:

 

Our Affiliates.

 

We may share Personal Information with our affiliates if they need your PI for our business purposes, e.g., in connection with your apartment rental or to respond to an application or other request of yours.

 

Third Parties Who Help Us Provide Services.

 

We may share your Personal Information with third parties who perform services on behalf of us or our affiliates. This may include third parties that assist with: website hosting, communications, bill or other payment processing actions, credit checks, criminal background checks, analyzing Site Use Information and other data, utility and insurance payments, screening of potential residents, collection or marketing services, and providing other various services. If these third parties need your PI to provide these services, we will share it with them.

 

Law Enforcement.

 

We reserve the right to report to law enforcement any activity that we believe is unlawful. In that connection, we may disclose Personal Information when we believe in good faith that the law or a governmental authority requires it. We may also disclose your PI to verify or enforce compliance with our "Terms" (or other agreements or policies governing the Site) and whenever we believe disclosure is necessary or useful to limit our legal liability, to protect or enforce our rights or interests or those of a third party, including other Site users, or in an emergency. You shall comply with all applicable laws and regulations when you use the Site in whole or in part.

 

Contests and Promotions.

 

If you choose to enter a contest or other promotion, your Personal Information may be disclosed to third parties, e.g., in connection with entry, winner selection, prize fulfillment, etc. Please review the rules of any contest or promotion you wish to enter because the rules may have specific requirements allowing the contest sponsor(s) to use your name, voice, likeness, or entry for advertising or marketing purposes.

 

Corporate Changes.

 

We may disclose and transfer your PI in connection with a merger, restructuring, sale, or other corporate transaction. In addition, if a potential buyer is interested in purchasing one of our properties, we may provide that buyer with information about the property and Personal Information of the tenants who live there, which may include you. If we sell that property, all related Personal Information is likely to be transferred to the purchaser.

UPDATING YOUR PERSONAL INFORMATION

Depending on where you are on the Site, you may be able to update your Personal Information. However, please note that we have no obligation to store your PI indefinitely and we may delete your Personal Information when we choose without liability for any such deletion or destruction.


Upon your request, we will: (a) correct or update your Personal Information; or (b) stop sending emails to your email address. You can make these requests by emailing privacy@homeproperties.com. Such information will be corrected or deactivated as soon as reasonably possible. Please note that we may need to retain certain information for record-keeping purposes, and there may also be residual information that will remain within our databases and other records. We reserve the right, from time to time, to re-contact former visitors to our website. Please note: we are not responsible for retracting Personal Information from third-party lists or from entities with which we have shared your information pursuant to the terms and conditions of this Policy.

 

SECURITY

 

The Site incorporates physical, electronic, and administrative procedures to safeguard the confidentiality of your Personal Information. We rely on third-party service providers for the physical security of some of our computer hardware and to provide certain services for your and our benefit. We believe that their security procedures are adequate.


However, while we believe we take reasonable steps to safeguard your PI, no Internet transmission is completely secure. Similarly, we cannot guarantee that any storage or processing of your Personal Information on the Site or on other servers or databases will be completely secure. FEEDBACK


We welcome your comments and feedback regarding this Site. However, we do not want, and cannot accept, any idea, material, or suggestion which you might consider to be confidential or proprietary. Therefore, any and all comments, feedback, ideas, and other submissions disclosed or submitted to us using the Site or otherwise (collectively, "Submissions") shall not be deemed confidential or proprietary to you; instead they will become and remain our property. CONSENT TO TRANSFER

CHILDREN


The Site is not directed to children or young adults. We do not knowingly collect Personal Information from anyone under the age of eighteen (18), and we will delete any information later determined to be from a person younger than 18.


OWNERSHIP


We own and operate the Site. All materials appearing on the Site are the property of Home Properties, Inc., our content providers, or our business partners.
